HB 752 Passed – The “Bathroom Bill” signed

Idaho House Bill 752 passed in both the House and the Senate and Governor Brad Little signed the “Bathroom Bill” into law on Tuesday evening.

This new Idaho bill makes it a crime to enter a restroom or changing room designated for the opposite biological sex in government buildings or public accommodations. House Bill 752 creates a misdemeanor penalty of up to one year in jail for a first offense. A second offense within five years would be elevated to a felony, carrying a potential prison sentence of up to five years.

The bill outlines several exceptions, including custodial or maintenance work, medical or law‑enforcement assistance, emergency situations, coaching during athletic events, and circumstances where only a single‑user facility is available. It also allows family members or designated caregivers to assist individuals or minor children who need help in a restroom or changing area.

The legislation defines “changing room” as any facility where a person may be undressed in the presence of others, such as locker rooms or shower rooms.

The bill will take effect on July 1, 2026.
