DOJ abortion lawsuit predictable

One could have predicted the federal lawsuit against Idaho challenging the abortion statute that would make criminals of health care professionals who respond to the needs of pregnant women in dire health care circumstances. The federal law requires health care facilities that receive federal funding to care for the health and safety of such women.

In many circumstances Idaho’s statute would require doctors to violate their professional oaths, trapping them between prosecution for saving lives or allowing their patients to die, in violation of federal law.

While the attorney general does not set policy, all Idahoans would benefit from statutes that come from good public policy ideas rather than political agendas.

Knowing that Idaho’s abortion statute violates the federal health care statutes, were I attorney general, I could not defend the Idaho law.
