Nevarez files $3.2- million tort

After being released from jail having served 167-days Thursday, December 12, after reaching a plea deal shortly before her felony trial was set to begin, JaMisha Nevarez, 46, also known as Misha Davis, filed a tort claim this week in Boundary and Bonner Counties and the City of Bonners Ferry seeking $3.2-million in relief.

Under Idaho Code, a tort claim is required before a government agency or employee can be sued. Upon filing, those named have 90 days to deny the claim or offer settlement. If denied, if the settlement offer is refused or if no action is taken by the end of 90 days, the claimant may proceed with a lawsuit.

Nevarez served a brief stint as CEO of the Bonners Ferry Seniors Center that began April 1 and culminated in her firing and arrest for trespassing and resisting arrest May 31. She was arrested, among other things, for allegedly threatening Boundary County Prosecutor Andrakay Pluid June 28 and charged with a felony under Idaho’s bribery and corruption statutes for threatening a judicial officer prosecuting a case against her.

Recipients include but are not limited to Boundary County Prosecutor(s) and City Attorney(s), Boundary County Clerk(s), Bonner County Public Defender, Boundary County Sheriff Department its Officers and Employees (911 Dispatch and EMT), Multiple Boundary County Elected Officials and Employees, John Does and Jane Does, and the Bonners Ferry City Police Department and its Officers.

“The claim arises from a series of unlawful actions and constitutional violations perpetrated by the named parties,” the claim reads. “These actions include wrongful prosecution, defamation, online slander, trial by media, targeted harassment, and gang stalking, resulting in significant damages to the claimant.”
