On March 12, 2020, Dr. Brian Drake was shot in the back at his office in Bonners Ferry, Idaho. Dr. Daniel Moore was accused of second-degree murder in criminal court but that was later thrown out. He then found himself in civil court after Brian Drake’s widow filed suit. The following is a part of the findings of fact, conclusions of law and decision dated February 6, 2025 by District Judge Susie Jensen:

“The default hearing to determine the nature of and amount of damages was conducted on January 29, 2025. Having reviewed the evidence submitted, the testimony provided, as well as the allegations of the Amended Verified Complaint, the Court hereby makes the following Findings of Fact and Conclusions of Law.
Daniel L. Moore shot and killed Brian Drake. In doing so, Daniel Moore acted willfully and maliciously and actually, directly, and proximately caused the death of Brian Drake.

The allegations of the Amended Verified Complaint and the evidence admitted at the hearing establish that Daniel L. Moore willfully and maliciously fired a gunshot through the window of Brian Drake’s office in close proximity to Brian Drake. These actions were extreme and outrageous, as well as intentional and reckless. These actions intentionally inflicted emotional distress on plaintiff Jennifer Drake as she audibly witnessed over the phone the shooting of her husband and his crying out to her in that conversation which was the last she would ever have with him.

Idaho Code§ 6-1604(1) provides that [i]n any action seeking recovery of punitive
damages, the claimant must prove, by clear and convincing evidence, oppressive, fraudulent
malicious or outrageous conduct by the party against whom the claim for punitive damages is
asserted.
On April 30, 2024, the Court held a hearing on plaintiffs’ motion to amend the complaint
to include a prayer for punitive damages. Applying the factors of Idaho Code § 6-1604, the
Court concluded that plaintiffs had established a reasonable likelihood of proving facts at trial
sufficient to support an award of punitive damages.
At the hearing of this matter, on January 29, 2025, plaintiffs proved, by clear and convincing evidence oppressive, malicious and outrageous conduct by Daniel L. Moore in taking the life of Brian Drake on the night of March 12, 2020, by shooting him through his office window.
IT IS HEREBY ORDERED that a judgment shall be entered in this matter in favor of plaintiffs and against defendants for the following amounts:
Total Compensatory Damages: $4,881,218
Total Intentional Infliction of Emotional Distress Damages: $500,000
Total Punitive Damages: $10,000,000
TOTAL: $15,381,218″

  1. No doubt Dr. Moore did it…only because our city assistant chief screwed up the case did he get away with not being held responsible in a criminal trial. Way to go Barney Fife!

    1. And now we have Zimmerman as Undersheriff, the same guy that had Barney fife as the assistant chief. Guess we can overlook that incompetence that allowed Moore a literal get out of jail card.

  2. Only because I’m active law enforcement do I not leave my name, but anyone in the profession knows exactly what Miranda is and how important it is to respect!

  3. Anyone with half a brain knew Moore did this murder (good old boy or not) and that law enforcement screwed the case up. No amount of money will replace Doctor Brian Drake but truth has finally come out after so long a time. May God bless Jennifer Drake and her family and perhaps this may bring some sort of closer for them.
